Terms of Service
Last updated: August 2026. Applies to the Tudu Customer App, Tudu Rider App, and Tudu Vendor App.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the applications operated by Tudu Africa Software Ltd ("Tudu"), including the Tudu Customer App, Tudu Rider App, and Tudu Vendor App. By downloading, installing, or using any of these applications, you agree to be bound by these Terms. If you do not agree, you must not use our services.
2. Definitions
- "Customer" means a user of the Tudu Customer App who places orders for goods and services.
- "Rider" means a user of the Tudu Rider App who accepts and completes delivery assignments.
- "Vendor" means a user of the Tudu Vendor App who lists and sells products through the platform.
- "Platform" means the technology, apps, and services provided by Tudu to connect Customers, Riders, and Vendors.
3. Our Services
Tudu provides a technology platform that connects Customers with Vendors for the purchase of food, groceries, pharmacy items, and other goods, and with Riders who deliver those goods. Tudu is a platform provider and intermediary. We are not the seller of goods, the employer of Riders, or the direct provider of services listed by Vendors.
4. Terms for Customers (Customer App)
- You must be at least 18 years old to create an account and place orders.
- You are responsible for providing accurate delivery information, including your Ghana Post GPS address or a clear landmark.
- Prices are set by Vendors and may change without notice. Delivery fees and service charges are displayed before checkout.
- Delivery times are estimates and may vary due to traffic, weather, demand, and other factors.
- Payment is required at checkout or on delivery. Accepted methods include MTN Mobile Money, Vodafone Cash, AirtelTigo Money, and cash on delivery where available.
- You agree to treat Riders and Vendors with respect. Abusive, threatening, or fraudulent behavior will result in account suspension or termination.
- Refunds and disputes must be reported through the app within 48 hours of delivery.
5. Terms for Riders (Rider App)
- You must be at least 18 years old, hold a valid driver's license (if operating a motorized vehicle), and have the legal right to work in Ghana.
- You are an independent contractor, not an employee of Tudu. You are responsible for your own taxes, vehicle maintenance, fuel, and insurance.
- You agree to maintain accurate location tracking while online and accepting deliveries. Location data is used for order assignment, navigation, and customer tracking.
- You must handle all goods with care and deliver them to the correct address within the expected timeframe.
- You agree to comply with all traffic laws and safety regulations. Repeated violations may result in deactivation.
- Earnings are paid weekly via mobile money or bank transfer. You are responsible for reporting your income to the Ghana Revenue Authority.
- Tudu may conduct background checks as required for safety and compliance.
- You must maintain a professional appearance and conduct. Complaints from Customers or Vendors will be investigated.
6. Terms for Vendors (Vendor App)
- You must be a legally registered business in Ghana or an authorized representative of one. You are responsible for all necessary licenses, permits, and health certifications.
- You are responsible for the accuracy of product listings, including descriptions, prices, images, and availability.
- You agree to prepare orders promptly and maintain quality standards. Late or inaccurate orders may result in penalties or removal from the platform.
- Tudu charges a commission on each completed order. Commission rates are disclosed during onboarding and may be updated with notice.
- Payouts are processed weekly via bank transfer or mobile money, net of commissions and applicable fees.
- You must comply with all food safety, health, and consumer protection laws in Ghana.
- You are solely responsible for product quality, customer complaints related to the product itself, and any recalls or safety issues.
7. Payments and Fees
All transactions processed through the Platform are subject to applicable taxes. Tudu may adjust service fees, delivery fees, and commission rates with reasonable notice. Payment processing is handled by third-party providers, and Tudu does not store full payment card details.
8. Intellectual Property
All content, trademarks, logos, and technology on the Platform are the property of Tudu Africa Software Ltd or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent. Vendors retain ownership of their product images and descriptions but grant Tudu a license to display them on the Platform.
9. Prohibited Conduct
All users agree not to:
- Use the Platform for any unlawful purpose.
- Engage in fraud, theft, or misrepresentation.
- Harass, threaten, or discriminate against other users.
- Interfere with the Platform's security or functionality.
- Circumvent the Platform to complete transactions outside of Tudu.
- Impersonate another person or business.
10. Limitation of Liability
To the maximum extent permitted by law, Tudu is not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim is limited to the amount paid for the specific order in question. Tudu is not responsible for the quality, safety, or legality of products sold by Vendors, or the conduct of Riders.
11. Termination
We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited conduct, or if required by law. You may deactivate your account at any time through the app or by contacting support. Upon termination, your right to use the Platform ceases immediately.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through negotiation. If unresolved, disputes shall be submitted to the courts of Ghana.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Material changes will be communicated via the app. Your continued use of any Tudu application after changes take effect constitutes acceptance of the revised Terms.
